1.2. Restrictions
The User must refrain from using the Services or accessing the Platforms and from accepting these Terms if:
(a) the User is not of legal age or lacks the capacity to agree to these Terms under applicable laws, unless they are duly authorized by their parents, guardians, or legally authorized representatives; or
(b) the User is a person prohibited from receiving the Services under the laws of their country of residence or the country from which they are accessing the Services.

1.3. Registration

To access certain personalized or specific Services, although it is not mandatory for general use, the User may choose to register by creating a username and password and activating an account (the “Account”). During this process, the User must provide a valid email address to receive notifications related to the Services.

By opting to create an Account, the User agrees to supply the required mandatory information and confirms that the information provided is accurate, complete, and current. It is the User’s responsibility to keep this information updated. If the User provides false, outdated, or incomplete information, or if getnowapps.com has reason to suspect such issues, we reserve the right to suspend or deactivate the User’s Account or restrict access to the Services associated with that Account.

The User must safeguard and keep their Account password confidential, refraining from disclosing it to others. The User shall not allow third parties to access their Account or use another User’s Account.

The User is responsible for all actions carried out through their Account on any Device. If the User suspects that a third party has gained unauthorized access to their Account, they should notify getnowapps.com immediately.

1.4. Authorized Use of the Platforms and the Services

The User commits to accessing the Platforms and utilizing the Services solely in accordance with these Terms and in good faith. The User agrees not to engage in negligent behavior or conduct that is illegal, nor to perform activities that violate applicable laws. Additionally, the User shall not attempt to attract Users of getnowapps.com to competing services or promote the sale of products or services for commercial purposes.

The User shall avoid interfering with the proper functioning of the Services or disrupting other Users’ use of the Platform. Specifically, the User shall not impersonate another person or User while interacting with the Services. Furthermore, the User agrees not to upload or submit content that is irrelevant or inappropriate to the Platforms, such as forums or comment areas. Any actions that damage, disable, overload, impair, or compromise the security or normal operation of the Platforms or the Services are strictly prohibited, including acts that hinder or interfere with their proper functioning.

Accessing the Platforms through automated tools such as robots, crawlers, or scripts designed to copy, control, or exploit the Platforms in a manner inconsistent with normal use or that unfairly restrict getnowapps.com’s interests is forbidden. Likewise, users are prohibited from attempting to acquire content from the Platforms using any method other than the standard access procedures authorized by getnowapps.com.

Adding serial numbers, cracked software, or similar content, as well as links to pages containing such materials, is strictly prohibited. Offenders’ IP addresses will be logged, and appropriate legal measures will be pursued. The User agrees not to engage in conduct that could harm the reputation, interests, or rights of getnowapps.com, other Users, or third parties.

The Services are personal to the User and may not be transferred or used by third parties, including affiliated companies, unless expressly authorized by getnowapps.com.

Please note that the Apps available on the Platforms are provided by their respective developers. Getnowapps.com facilitates the hosting and distribution of these Apps but does not edit, select, or oversee their content. We do not endorse, warrant, or take responsibility for the Apps, nor for any opinions, recommendations, or advice expressed within them.

While getnowapps.com is not obligated to monitor all Apps, we reserve the right to modify or remove any App or related content at any time in our sole discretion, especially if we believe it violates these Terms, is offensive, illegal, or infringes upon third-party rights.

Should a material breach of these Terms occur, or if the breach causes harm to getnowapps.com or third parties, we reserve the right to take appropriate measures, including suspending or blocking access to the Services and seeking compensation for damages. These actions are without prejudice to other legal rights or actions available to getnowapps.com to protect its interests.

2.1. Registration

To place an order for a Service for Purchase, the User must access the Services through a registered Account. If the User does not already have an Account, they must first complete the registration process outlined in section 1.3 of these Terms. During the purchasing process, the User will be required to provide additional information, such as delivery and billing address, tax identification number, and any other details specified by the Platform, following the instructions provided on getnowapps.com or within the GNA app.

2.2. Prices and Invoicing

The prices for Services for Purchase are displayed on getnowapps.com or within the GNA app, in the currency applicable to the transaction, and include, when necessary, the corresponding Value Added Tax (VAT) based on the delivery location and the User’s residence.

Smartago LLC reserves the right to change the prices of the Services at any time. However, the price applicable will be the one in effect at the time the User places the order.

Prior to confirming the purchase and completing the payment, the User will be informed of the total final price, including all applicable fees and charges.

Once the transaction is completed, getnowapps.com will send a confirmation email to the address associated with the User’s Account, confirming the purchase of the Services.

The Terms, along with any specific conditions related to the Services for Purchase, can be downloaded or printed by the User during the purchase process. Additionally, a digital proof of payment will be generated, and the User can review their payment history at any time within their Account on the Platform.

2.3. Payment

The User can settle the cost of Services for Purchase using the accepted payment methods specified during the transaction process. To complete the payment, the User must follow the instructions provided on getnowapps.com or within the GNA app.

If paying by credit card, the User must enter the card details. Payment processing is secured through encryption systems that protect the transmission of bank information over the Internet. The Services for Purchase will only be activated once the payment has been successfully received or authorized by the relevant financial institution.

All payment information management is conducted directly between the User and the third-party payment platforms; getnowapps.com does not access or handle the User’s bank data at any time.

2.4. Right of Withdrawal

The User has the right to withdraw from the contract for Services for Purchase within fourteen (14) calendar days from the date of the contract. If the Service for Purchase is provided free of charge, this withdrawal period also begins at the time of contracting, even if no payment is yet due. In the event of withdrawal, the User is entitled to a full refund of any payments made.

To exercise the right of withdrawal, the User must communicate their decision clearly through an unambiguous statement, such as a letter sent by postal mail, fax, or email. The withdrawal form included at the end of these Terms may be used, but its use is not mandatory.

Please note that the right of withdrawal is only available where mandated by law. Specifically, refunds for cancellations within fourteen (14) days of contracting apply only to Users residing in the European Union, the European Economic Area, the United Kingdom, and other countries where local regulations require such protections.

Furthermore, the right of withdrawal will not apply in cases where the Service for Purchase has been fully provided or where the Service involves digital content supplied on a non-material support, provided the User has expressly consented to its immediate provision. If the Service for Purchase has been partially provided at the time of withdrawal, the User shall be responsible for the portion of the Service that has already been delivered until the withdrawal is exercised.

2.5. Special Terms Applicable to Subscriptions

This section 2.5 applies to purchases of any premium subscription Service (the “Subscription”) made through getnowapps.com or the GNA app, in addition to the other terms outlined in this Section 2. These Subscriptions grant the User access to additional functionalities not available in the free version of the Services.

Occasionally, the Subscription may include a free trial period, allowing the User to access and use the premium features free of charge. At the conclusion of the trial period, starting from the following day, the Subscription will automatically activate at the applicable rate unless canceled by the User before the trial ends, and the corresponding payment will be charged.

By selecting the Subscription, the User authorizes Smartago LLC to charge the agreed-upon price via the selected payment method. Except during free trial periods, the Subscription will only take effect once the payment has been successfully received or authorized by the relevant financial institution. From that point forward, the Subscription will remain active for the period initially contracted.

Subscriptions will automatically renew at the applicable rate upon expiration of each term, continuing until the User cancels the Subscription.

Smartago LLC reserves the right to adjust the renewal price or modify the terms of the Subscription (including cancellation procedures), provided that the User is notified at least one month prior to the date such changes take effect.

3.1. Use of the Services Available on getnowapps.com

Subject to compliance with these Terms, Smartago LLC grants the User a non-exclusive, limited, revocable, personal, and non-transferable license to access and use the getnowapps.com Platform and the GNA app solely for the purpose of receiving the Services, in accordance with these Terms and to the extent authorized. Except for this license, all intellectual and industrial property rights in the Services, the Platform, the App, and all related elements remain vested in Smartago LLC or its licensors.

Unless a separate license agreement is provided to the User by the rights holder (which can be submitted to Smartago LLC upon request), the User agrees to use the Apps and other content available through the Services solely for personal use. The User shall not engage, directly or indirectly, in the commercial exploitation of the products, services, or results obtained through the use of the Platforms and Services, nor transfer or distribute them for commercial purposes.

3.2. Prohibited Conduct

The User agrees to abstain from engaging in any behavior while using the Platforms and the Services that undermines the intellectual or industrial property rights of Smartago LLC or its licensors, infringes upon or violates the honor, personal or family privacy, or image of third parties, or is illegal or harms moral standards.

In particular, and without limitation, the User shall avoid performing acts that could destroy, alter, disable, or damage electronic data, programs, or documents belonging to Smartago LLC, its licensors, or third parties. The User shall not introduce or disseminate on the network any programs, viruses, applets, Active X controls, or devices—whether physical or electronic—that could cause or are likely to cause any alteration or damage to the network, systems, or third-party computers.

Furthermore, any activity or practice that contravenes accepted principles of good conduct among Internet users is expressly prohibited.

3.3. Content Uploaded on getnowapps.com by the User

The User is exclusively responsible for all materials or content they upload, post, email, or otherwise add to the Platforms or the Services (collectively referred to as the “User Content”). The User warrants that they hold all necessary intellectual and/or industrial property rights to the User Content.

By using the Platforms and the Services and by uploading, posting, emailing, or contributing User Content, the User grants Smartago LLC, its affiliated and associated companies, and its collaborators an irrevocable, royalty-free, non-exclusive worldwide license, with the right to sublicense, for the duration of the rights held, to reproduce, modify, distribute, and publicly communicate the User Content on the Platforms, the current and future Services, and affiliated sites, including for promotional purposes.

Smartago LLC may distribute the User Content to other Users or make any other use of it through any media, method, or format now known or developed in the future.

3.4. Requirement to Report Noncompliance

Any suspected violation of rights or infringement occurring on the Platforms or through the Services should be reported to Smartago LLC by submitting a detailed description of the alleged infringement via email at the following link: https://www.getnowapps.com/us/contact/.

We may revise these Terms at any time. If changes are significant, we will provide notice through the Services or other communication channels. Continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
